A Butler County physician was held for court yesterday on a second round of sexual assault charges, these involving two teenaged boys who were under the doctor's care at a local juvenile detention facility.
Dr. David Allen Evanko, 56, of Butler Township, is charged with two counts each of institutional sexual assault, unlawful contact with a minor, corruption of minors, endangering the welfare of children and indecent assault.
The doctor was held for court in May on accusations of involuntary deviate sexual intercourse and related charges in connection with the molestation 20 years ago of a boy he supervised as a scout leader.
Dr. Evanko is free on bond in both cases.
Two teenaged boys testified yesterday before District Judge Lewis Stoughton, of Chicora, that they came in contact with Dr. Evanko when they sought treatment for genital problems while they were residents of the Summit Academy, a juvenile facility in Herman, Butler County. The assaults allegedly occurred between April 2008 and March. Dr. Evanko was on a $1,000-a-month retainer to provide medical services.
Both boys testified that Dr. Evanko touched them in a way that they perceived to be inappropriate. The Pittsburgh Post-Gazette does not name alleged victims of sexual assault.
Defense attorney David DeFazio, of Butler, argued following the hour-long hearing that the boys aren't qualified to contend that their medical treatment wasn't appropriate. "Whether they were scared, embarrassed or felt violated is irrelevant. Anyone who has had a colonoscopy can feel violated. ... That doesn't mean [the doctor's] methodology or protocol was inappropriate," the attorney contended.
The case was prosecuted yesterday by Amy Carnicella of the Pennsylvania attorney general's office in Pittsburgh. The Butler County district attorney's office and all of Butler County's judges have removed themselves from the case due to a professional relationship with the doctor.
