Attorneys for Steelers quarterback Ben Roethlisberger yesterday responded point-by-point to the civil lawsuit filed against him by a Nevada woman accusing him of sexual assault and countersued her for unspecified damages.
In the filing, John Echeverria, Mr. Roethlisberger's Reno-based attorney, said the woman, an employee of Harrah's Lake Tahoe, willingly entered Mr. Roethlisberger's room on July 11, 2008, with plans to seduce him.
"At all times while she was in Mr. Roethlisberger's room, [the woman] acted voluntarily," Mr. Echeverria said. "Mr. Roethlisberger did not sexually assault, assault, batter, falsely imprison, or otherwise commit any crime or tort against [her]."
The 31-year-old woman, a casino host at Harrah's, filed a civil suit in Reno in July claiming Mr. Roethlisberger, who had been in Lake Tahoe for a charity golf outing, lured her into his room by saying his television wasn't working and then raped her.
The Post-Gazette does not identify alleged victims of sexual assault.
Mr. Roethlisberger has forcefully denied the accusations and attorneys for the two sides have spent the past three months trading legal filings and accusations.
Yesterday's 33-page filing, however, was the first in which Mr. Roethlisberger's legal team responded to each of the 270 specific paragraphs in his accuser's original legal complaint.
Most of the responses amount to Mr. Roethlisberger's contention that he knows nothing about the claims and therefore denies them. These include his denial that he said his television was not working and his denial that he asked the woman to enter his room to fix it.
Mr. Roethlisberger admitted that the woman came to his door and knocked on it, but he denied opening it "wearing athletic shorts and a T-shirt," and he denied that "the room was a mess."
He admitted that she entered the room, but denied all of her statements about the television, and he denied blocking her way out of the room. He also denied grabbing her and kissing her.
"Mr. Roethlisberger admits that he was friendly and a gentleman in all of his contacts" with her, Mr. Echeverria said, but he denied assaulting her.
"Mr. Roethlisberger asserts that [the woman] capably, deliberately and voluntarily consented to and approved of all the acts and omissions about which [she] now complains, and which form the basis of all the claims for relief," the filing said.
Mr. Echeverria said the woman "used her position as a casino host to flirt" with Mr. Roethlisberger and that her conscious violation of Harrah's policy against employees entering guests' rooms "was a deliberate step in her plan to seduce Mr. Roethlisberger."
The counter-suit accuses the woman of "extortion, abuse of process and defamation," and seeks unspecified damages in excess of $10,000 to compensate for "lost opportunity for endorsement deals and other revenues, damage to his reputation, emotional distress and legal fees and costs."
Calvin R.X. Dunlap, attorney for the woman, could not be reached for comment last night.
