The family of the 89-year-old woman who died on the roof of UPMC Montefiore has asked Common Pleas Court to give it access to reports from authorities regarding the woman's death.
A writ of summons, filed yesterday, would allow the family of Rose Lee Diggs to gather information to prepare a wrongful death suit, said Robert F. Daley, an attorney for the family.
Mr. Daley said the family is seeking subpoena power for investigative reports on the death prepared by the Allegheny County medical examiner, the district attorney's office, Pittsburgh police and the Department of Health.
Ms. Diggs, of Homewood, suffered from dementia and heart problems and had a history of wandering. The night of Dec. 2, according to police, she left her 12th-floor room through a fire exit. Her body was found the next morning by a maintenance worker, with injuries suggesting a fall. She was wearing only a hospital gown and slippers on a night when the temperature dropped to 23 degrees.
