Allegheny County District Attorney Stephen A. Zappala Jr. has decided no charges should be filed against a Plum man for shooting and wounding an intruder earlier this month.
James Bodnar, 68, told police he shot the man, Justin Jones, 21, in both legs when Mr. Jones tried to enter Mr. Bodnar's apartment about 1:30 a.m. Jan. 9.
Mr. Jones, of Auburn, N.Y., was likely trying to enter his ex-girlfriend's apartment in the same complex, police have said.
Mr. Bodnar said he opened his door after Mr. Jones had tried to kick it open.
The older man showed the gun to Mr. Jones, and fired the weapon after Mr. Jones persisted in trying to enter the apartment.
Mr. Jones is being held in the county Jail, pending a preliminary hearing Wednesday before District Judge Linda Zucco in Plum.
He is charged with reckless endangerment, attempted trespassing, disorderly conduct, criminal mischief, public drunkenness, and loitering and prowling.
